Where We Are in the Process of Creating the Nueces Groundwater Conservation District (NGCD)
An Overview of What’s Happening and How You Can Stay Informed
This page represents the landowners who filed the petition to create the proposed Nueces Groundwater Conservation District (NGCD).
The proposed district is not official yet. Several key steps must take place before residents have the opportunity to vote on whether to formally establish the NGCD.
The goal of this page is to provide clear, transparent updates so that all residents within the proposed district boundaries understand the process, the timeline, and how to stay engaged.
About the NGCD Formation Process
Creating a groundwater conservation district in Texas follows the legal framework established under Chapter 36 of the Texas Water Code. The process is designed to ensure transparency, public participation, and state-level review through the Texas Commission on Environmental Quality (TCEQ).
Here’s where we are in that process:
🗂 Step 1 – Petition Filed
✅ Landowners submitted the petition to create the NGCD to the Texas Commission on Environmental Quality (TCEQ).
🔍 Step 2 – Petition Review
TCEQ’s Executive Director reviews the petition to ensure it meets all statutory requirements.
If additional information is needed, petitioners are given time to provide it.
Once the petition is determined to be complete, it moves forward to the next stage.
📢 Step 3 – Public Notice & Hearing
TCEQ issues a public notice about the petition and schedules a public meeting within the proposed district area.
This meeting allows local residents to ask questions and provide comments before any decision is made.
🏛 Step 4 – TCEQ Decision
After reviewing public feedback and documentation, TCEQ considers whether the petition is administratively complete.
If it meets all requirements, the Commission may certify the petition and appoint a temporary board with limited administrative authority to prepare for an election.
🗳 Step 5 – Confirmation Election
Once authorized, an election is called within the proposed district boundaries.
Residents will then vote for or against creating the Nueces Groundwater Conservation District.
A majority “YES” vote officially establishes the district.
A majority “NO” vote means the district is not created.
📌 Final Step – Local Governance
If the district is confirmed by voters, the newly established NGCD will operate under local control through an elected board of directors, as required by state law.
This board will then begin developing rules, management plans, and public processes to guide groundwater management within the district.
Until Then — The District Is Pending Approval
Until the TCEQ review and confirmation election are complete, the Nueces Groundwater Conservation District remains a proposal.
